If your asylum or human rights application has been refused and all appeal rights are exhausted, you may still submit a fresh claim if new evidence arises.
What Is a Fresh Claim?
A fresh claim involves submitting new, significant evidence not previously considered. It must create a realistic prospect of success if reviewed by a tribunal.
When to Submit
- After your appeal is dismissed
- When you obtain new country reports, medical evidence, or family changes
- If political or legal conditions in your home country worsen
Examples of Valid Evidence
- Mental health diagnosis
- Reports of increased persecution
- Marriage to a British citizen
- Birth of British child
- New documentation of past abuse
What If Refused?
If the Home Office rejects your claim, judicial review may be an option.
