Would I Be Able to Claim My Legal Expenses Back if I Win the Case?
The general rule is that the “loser” pays the costs of the “winner”. In most cases where it is evident who the “winner” of the case was, the loser will be ordered to pay the legal costs of the “winner”.
However, ordinarily, if your matter is allocated to a small claims track any costs you have incurred in obtaining legal advice and representations will not be recoverable. Sometimes, the amount which is recoverable is pre-fixed, for example, in a fast-track claim.
