What is a Money Claim?
If you are owed money by a person or business you can apply to the Court to claim the money that you are owed.
How much would it cost to bring a claim?

In addition to the court fees, you will pay the Solicitor’s fees for taking your instructions, drafting the Claim Form and filing and serving the same.

Would I be able to claim my legal expenses back if I win the case?
The general rule is that the “loser” pays the costs of the “winner”. In most cases where it is evident who the “winner” of the case was, the loser will be ordered to pay the legal costs of the “winner”.
However, ordinarily, if your matter is allocated to a small claims track any costs
you have incurred in obtaining legal advice and representations will not be
recoverable. Sometimes, the amount which is recoverable is pre-fixed, for
example, in a fast-track claim.
What track is allocated to a case is usually determined by the value of the
claim and the complexity of the matter. There are now four tracks.
Straightforward, simple claims for £10,000 and under are generally allocated to
Small Claims Track.
Fast Track claims are normally for a value above £10,000 but under £25,000.
The intermediate track is for claims which have a value of £25,000 but less
than £100,000. The amounts recoverable in each case will be determined by
what stage the case was when the matter was resolved and the band of the
case.
Finally, the multi-track is allocated to claims which are above £100,000 and which normally involve complex issues for the Court to determine. In Multi
Track cases the Court normally pre-manage costs. Parties who are legal represented, would be required to prepare costs budgets for agreement by the opponent and court, this is to ensure that the costs in the case do not become
disproportionate to the value of the claim.
